The Law Council of Australia and International Bar Association’ s human rights institution thank the special Rapporteur for her report recognizing the vital role of legal professionals in safeguarding the rule of law and democracy.
We are deeply concern that Hong Kong’s safeguarding National Security Ordinance restricts the right to freedom of expression,assembly and association and undermines the right to a fair trial.
The broadly defined defense is less efficient circumstances for legitimate activities of individuals,association and civil society organizations protected under international law.
But Hong Kong’s Basic Law guarantees access to confidential legal advice from a lawyer once choosing the ordinance established as a framework to deny access to a lawyer and refuse access to certain lawyers or firms.
This violates international fair trial standards and the right to legal assistances.The ordinance empower the executive to suspend the professional qualification.
The ordinance…(didn’t get the words)due process guarantees and peer reviews and undermines the profession independence.
We urge the Special Rapporteur to continue monitoring the laws’ implementation and call on Hong Kong to establish mechanisms for regular independent review,national security legislation looking to models adopted by Australia and United Kingdom to ensure such laws remain necessary proportion and compliant with international obligations and human rights standards.
